Terms & Conditions

1. Introduction
These Terms and Conditions ("Terms") govern the use of the Young Einsteins website and the provision of our tutoring services. By accessing our website, submitting an enquiry, or engaging our services, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use our website or services.
2. Definitions
- "We", "us", "our" refers to Young Einsteins.
- "Client" refers to the parent or guardian who engages our services.
- "Student" refers to the individual receiving tutoring services.
- "Services" refers to tutoring sessions, programs, and related educational support.
3. Eligibility and Parental Responsibility
Our tutoring services are primarily provided to students under the age of 18. By engaging our services, the parent or legal guardian confirms that they have authority to enter into this agreement on behalf of the student, that all information provided about the student is accurate, and that they accept responsibility for payments, communication, and compliance with these Terms.
4. Services Provided
Young Einsteins provides academic tutoring in English, Mathematics, and selected Science and ATAR subjects, delivered in person in small groups (usually 5-6 students) or as private lessons on request. We reserve the right to modify, reschedule, or discontinue any session or program at our discretion, subject to reasonable notice where possible.
5. Enquiries, Bookings and Payments
Places are arranged directly by phone or email rather than through this website. Fees and payment arrangements (such as pay-per-lesson, monthly, or term-based options) are communicated directly to the Client before a place is confirmed. Failure to make payment by the agreed date may result in suspension or cancellation of a student's place.
6. Cancellations and Missed Sessions
To ensure fairness and maintain consistent learning quality:
- Parents must notify us of a student's absence at least 24 hours before the scheduled session, by text message.
- Tuition fees are still charged in full for absences with 24 hours' notice, as we are usually unable to arrange another student for that time at short notice; no fee exemption applies.
- Absences with notice will be offered a make-up lesson in another class covering equivalent content, when a suitable time is available.
- Parents may choose the make-up date within 3 months, including during school holidays. After 3 months, the make-up lesson will expire.
- If a student is absent without notice, that session will not be eligible for a make-up lesson.
- If a student is absent due to travel, the tuition fee may be waived for that period.
- In cases of family emergencies or sudden, unforeseen illness, a credit will be issued at our discretion.
- We kindly ask that parents respect scheduled session times and avoid late cancellations.
7. Refunds and Australian Consumer Law
We comply with the Australian Consumer Law. You are entitled to a refund, replacement, or remedy where our services fail to meet consumer guarantees. Change of mind, scheduling conflicts, or lack of academic improvement do not automatically entitle you to a refund. Where a refund is applicable, it will be assessed on a case-by-case basis.
8. Academic Results Disclaimer
Young Einsteins does not guarantee academic grades, ATAR results, exam outcomes, or university entry. Academic performance depends on multiple factors including student effort, attendance, school curriculum, and individual ability. Any examples of past results are indicative only and do not constitute a guarantee.
9. Student Conduct and Safety
Students are expected to behave respectfully towards tutors and other students, engage constructively during sessions, and follow reasonable instructions provided by tutors. We reserve the right to suspend or terminate services without refund where behaviour is disruptive, unsafe, or inappropriate.
10. Photography and Media
We may occasionally take photographs during sessions for use on our website or social media (for example, to show what a small-group lesson looks like). Photographs identifying a student will only be used with the Client's prior written consent, which may be withdrawn at any time by contacting us.
11. Intellectual Property
All tutoring materials, worksheets, lesson plans, and resources remain the intellectual property of Young Einsteins. Materials may not be copied, shared, resold, or distributed without written consent.
12. Acceptable Use of Website
When using our website or contact form, you agree not to submit unlawful, defamatory, obscene, or harassing content, impersonate another person, use automated tools such as bots or scripts to submit or scrape the website, or upload or transmit any virus, malicious code, or content that could damage or disrupt the website or its functionality.
13. Third-Party Links
Our website contains links to third-party platforms such as Facebook and Instagram. We are not responsible for the content, accuracy, or privacy practices of these third-party sites, and including a link does not imply our endorsement of them. Please review each platform's own terms and privacy policy before using it.
14. Indemnity
You agree to indemnify Young Einsteins against any claims, losses, or damages arising from your misuse of this website, including any breach of these Terms or unlawful use of the contact form.
15. Privacy
Personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
16. Complaints and Disputes
If you have a concern about our services, please contact us directly by email or by phone/SMS so we can work towards a fair resolution. We aim to respond to complaints promptly and in good faith.
17. Termination
We reserve the right to terminate services where fees remain unpaid, these Terms are breached, or continued service is not appropriate or feasible.
18. Force Majeure
We are not liable for any failure or delay in providing services caused by circumstances beyond our reasonable control, including illness, extreme weather, or other events preventing a session from safely proceeding. Where this affects a scheduled session, we will contact affected families to arrange a rescheduled time.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
20. Changes to These Terms
We may update these Terms from time to time. Updated versions will be published on our website with a revised effective date.
